DESCRIPTION OF POS TERMINAL

The POS Terminal provided by ATOR Ltd. on www.atorltd.com shall be solely used for transactions in relation to the legal services that our company is offering; the POS Terminal shall not be used for any of the other services, described on the website.

A)    General

You shall also not forge headers or manipulate identifies or other data in order to disguise the origin of any Content and/or User Content transmitted through our Web Site or to manipulate your presence on the Web Site. You and your company shall not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any ATOR Ltd. server or to any of the Services, through hacking, password mining or any other means. You and your company shall not operate robots or spiders to scan ATOR Ltd.'s databases or web pages. You and your company shall not use "deep linking" to ATOR Ltd.'s web pages.

 

B)     Misuse of Communications

 

The Services contain message and communication facilities designed to enable you or your company to communicate with others. You and your company agree to use the Services only to post, send and receive messages and material that are proper and permitted by applicable law. By way of example, and not as a limitation, you agree that when using the Services, you and your company will not:

·         Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

·         Send or otherwise make available any inappropriate, profane, defamatory, obscene, abusive, racist, indecent or unlawful topic, name, material or information.

·         Send or otherwise make available any information or material that may constitute or encourage conduct that is a criminal offense or civil wrong, e.g. insider trading information about a company or proprietary or confidential information of a third party

·         Impersonate any person or entity or make any false statements regarding any agency or affiliation with any entity or create a false identity.

·         Send, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you or your company own or control the rights thereto or have received all necessary consent to do the same.

·         Use any material or information, including images or photographs, which are made available through the Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.

·         Send files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.

·         Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material that is sent.

·         Provide material support or resources (or conceal or disguise the nature, location, source or ownership of material support or resources) to any organization designated as a foreign terrorist organization by the U.S. government.

 

C)    Monitoring of the Service

 

ATOR Ltd. has no obligation to monitor the Services. However, ATOR Ltd. reserves the right to review materials sent through the Services and to remove any materials in its sole discretion.

ATOR Ltd. does not control or endorse the content, messages or information found in any Services and, therefore, ATOR Ltd. specifically disclaims any liability with regard to such content, messages or information.

 

D)    Remedies for Misuse

 

Without limiting other remedies, ATOR Ltd. may limit, suspend or terminate the Services and your company's accounts, delay or remove your company's content, or use other technical and legal measures to stop you and your company from causing harm, if ATOR Ltd. believes that your company's activities are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of these TOU or ATOR Ltd. policies.

User Name and Password

When you, the Member, create and open an account with ATOR Ltd., you will be asked to provide a user name and password. You are entirely responsible for maintaining the confidentiality of your password and user name and any other security information related to your account. You will be fully responsible for all activities that occur under your account, user name and/or password. You may not use the account, username or password of someone else at any time. You will immediately notify ATOR Ltd. of any unauthorized use of Member's password, user name, e-mail, or any other breach of security. ATOR Ltd. encourages Member to change their password at least once a month. ATOR Ltd. will not be liable for any loss that you incur as a result of someone else using your account or your password, either with or without your knowledge. ATOR Ltd. will hold you liable and responsible for any losses incurred by ATOR Ltd. due to someone else’s use of your account or password.

Links & Advertisements

The Sites may contain links or other content related to web sites, products and/or services offered by third parties. ATOR Ltd. has no control over any such links, content, web sites, products or services or any information provided or transmitted via such links, web sites, products or services, or otherwise provided by any such third party. The Member acknowledges and agrees that ATOR Ltd. is not responsible for the availability of such third party links, content, web sites, products or services and will not be responsible or liable for any content, advertising, products or other materials contained therein or the business practices or privacy practices related thereto. The Member warrants and agrees that ATOR Ltd. will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such link, web site, content, product and/or service. ATOR Ltd. encourages the Member to, at a minimum, be aware when he or she leaves a Site and to review the privacy practices related to third party sites.

 

7. Limitation of Liability

 

 EXCEPT AS OTHERWISE EXPRESSLY STATED IN THE AGREEMENT, IN NO EVENT SHALL ATOR LTD. OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF USE, DATA OR PROFITS OR DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES. THIS DISCLAIMER OF LIABILITY APPLIES TO ALL CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE AND REGARDLESS OF WHETHER ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

If you have a dispute with one or more users, you release ‘ATOR’ Ltd. of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

 

12. Termination by Client

 

The client can cancel any orders by e-mail, within 24 hours of the initial order request.

 

13. Termination by ATOR Ltd.

 

ATOR Ltd. reserves the right to terminate your access to any or all of the Services at any time, without notice, for any reason whatsoever.

 

14. Dispute Resolution

 

These Terms of Use shall be governed by and construed in accordance with the laws of Bulgaria. You agree to the non-exclusive jurisdiction of the courts in Bulgaria for any disputes, claim or cause of action arising out of, or relating to or in connection with these Terms of Use or your use of this Web Site, including any disputes relating to the existence or validity of these Terms of Use, provided that you agree to submit any such disputes, claims or causes of action exclusively to the courts of Bulgaria.

 

15. Severability

 

If any provision of these Terms of Use is held to be invalid or unenforceable, then the invalid or unenforceable provision will be replaced by a valid, enforceable provision that most closely matches the intent of the original provision and the remaining provisions shall be enforced.

 

16. No Waiver

 

No failure on the part of ‘ATOR’ Ltd. to enforce any part of these Terms of Use shall constitute a waiver of any of ‘ATOR’ Ltd.' rights under these Terms of Use, whether for past or future actions on the part of any person. Neither the receipt of any funds by ‘ATOR’ Ltd. nor the reliance of any person on ‘ATOR’ Ltd.' actions shall be deemed to constitute a waiver of any part of these Terms of Use. Only a specific, written waiver signed by an authorized representative of ‘ATOR’ Ltd. shall have any legal effect whatsoever.
